Acceptance of terms

By accessing this website or attending Twin Cities FoilFest, you agree to these Terms of Service. If you do not agree, please do not use the website or attend the Event.

The Event is free and informal

FoilFest is a free, volunteer-organized community gathering hosted at a private residence. It is not a commercial event, and attendance is a privilege extended by the hosts. The hosts reserve the right to refuse entry to, or ask any person to leave, at their sole discretion.

Assumption of risk

eFoiling, foiling, boating, swimming, and related watersports are inherently dangerous activities that involve risk of serious injury, drowning, equipment failure, and death. Participation is entirely voluntary and at your own risk. You are solely responsible for assessing your own physical fitness, ability, and comfort level before participating in any activity. You agree to follow all safety briefings, instructions from hosts and instructors, and applicable laws, and to wear appropriate safety equipment. Any equipment demos or lessons are provided on an as-is basis.

Release and waiver of liability

To the fullest extent permitted by applicable law, you release, waive, and agree not to sue the hosts (including Brook and Barb Duerr), organizers, volunteers, instructors, sponsors, and participating partners from and against any and all claims, liabilities, injuries, losses, or damages arising out of or related to your attendance at the Event or use of any equipment, property, or the water, whether caused by ordinary negligence or otherwise, except where such a release is prohibited by law. This release does not apply to conduct that is found to be willful, reckless, or grossly negligent, or to any liability that cannot be waived under applicable law.

No warranties

This website and the Event are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee that the website will be error-free or that any information (including schedules, directions, or activities) is complete or accurate, and details are subject to change or cancellation, including for weather.

Limitation of liability

To the maximum extent permitted by law, in no event will the hosts, organizers, or partners be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or attendance at the Event.

Personal property
